By booking or attending our classes and events, you agree to these Terms and Conditions.
1. OUR SERVICES
1.1 Fitness Instruction
All instructors are qualified fitness professionals specialised in prenatal and postnatal exercise. Elena is also a registered midwife. Group fitness classes constitute fitness instruction, not clinical care. Midwifery services (Postnatal MOTs, consultations, feeding support) are provided separately by Wise Mamas Midwifery.
1.2 Not Medical Advice
Nothing in fitness classes constitutes medical diagnosis or treatment. You must consult your own GP, midwife, or healthcare provider regarding your specific health needs. While our programming is evidence-based and developed with medical professionals, it does not replace your individual medical advice.
2. YOUR HEALTH & SAFETY
2.1 Health Disclosure
It is your responsibility to accurately disclose all relevant health information and update us immediately if your health status changes including: pregnancy status and complications, pelvic floor issues, injuries, medical conditions, and any exercise restrictions advised by healthcare professionals.
2.2 Medical Clearance
While not required for most, we recommend discussing exercise with your healthcare provider. In the case of some health conditions or pregnancy complications, medical clearance may be required.
2.3 Your Responsibilities
Exercise within your limits, stop immediately if you feel pain/dizzy/unwell, inform the instructor of concerns, follow instructor guidance, and not participate if unwell or medically advised against exercise.
2.4 Understanding Risks
Physical exercise carries inherent risks including muscle soreness, strains, sprains, dizziness, falls, and rarely more serious injury. These risks increase during pregnancy and postnatally. We take reasonable precautions but cannot eliminate all risks.
3. CHILDREN
3.1 Welcome & Supervision
Children are always welcome. You remain solely responsible for your child's safety and supervision at all times. Children must stay in the same room and within your sight. The kids' area is not supervised childcare.
3.2 Your Liability
We are not liable for injuries to children unless caused by our negligence. If your child injures another person or child, this is between parents/guardians. You are responsible for any damage your child causes to our property.
4. OUR RESPONSIBILITIES & LIABILITY
4.1 What We Provide
Qualified, insured instructors; evidence-based safe programming; well-maintained facilities; a welcoming community.
4.2 What We Cannot Exclude Liability For
Death or personal injury caused by our negligence; fraud; breach of statutory rights under Consumer Rights Act 2015; anything that cannot be lawfully excluded under UK law.
4.3 What We Are Not Liable For
Subject to 4.2, we are not liable for: injuries from inherent exercise risks despite reasonable precautions; injuries from your failure to disclose health information or follow guidance; aggravation of undisclosed conditions; injuries to children under your supervision (unless our negligence); loss/theft of personal property; indirect losses (travel costs, childcare, earnings); outcomes of third-party services.
4.4 Your Agreement
You agree to take reasonable care for your own and your children's safety, not make claims for injuries from inherent risks where we've taken reasonable care, and indemnify us against claims arising from your breach of these Terms, your negligence, your children's actions, or false health information.
5. PAYMENT & CANCELLATIONS
5.1 Payment Terms
- Ongoing membership: Monthly Direct Debit, taken on the same date each month as your start date
- Postnatal Recovery Program: £180 total (upfront or 3 x £60 monthly via Direct Debit)
- Drop-ins/1:1 sessions: Payment due at booking
5.2 Postnatal Program Commitment
If choosing the payment plan, you remain liable for the full £180 even if you stop attending. This 12-week progressive program pricing reflects this commitment. Non-refundable once started (except exceptional circumstances at our discretion).
5.3 Membership Cancellation by You
One month's notice. Notice must be received before the month starts to avoid charges for that month. Example: Cancel by December 1st to stop paying from January 1st; notice on December 15th means you pay for January and cancel from February 1st.
5.4 Your Class Cancellations
Cancel up to 1 hour before class via the booking system. Cancellations with less than 1 hour's notice or no-shows forfeit the class (no refund/credit).
5.5 Our Cancellations
We may cancel classes due to instructor illness, facility issues, or circumstances beyond our control. In most cases you'll be able to make up your missed class. If not, you'll receive full credit or refund. We're not liable for consequential losses (travel, childcare, earnings).
5.6 Refunds
- Ongoing membership: No partial month refunds (give full month's notice per 5.3)
- Postnatal Program: Full refund if cancelled before start date; no refunds once commenced (except exceptional circumstances)
- Drop-ins: No refunds for cancellations under 12 hours
5.7 Membership Freeze
Freeze for up to 3 months/year (minimum 2 weeks). Give 7 days' notice. No payments during freeze. Email hello@wisemamas.co.uk to request.
6. TERMINATION
We may terminate your membership immediately without refund if you: provide false health information endangering others; behave aggressively, abusively, or disrespectfully; fail to supervise children after warnings; repeatedly disrupt classes; damage property; materially breach these Terms; or fail to pay after reasonable notice. No refunds given. Outstanding payments remain due.
7. CODE OF CONDUCT
You agree to: treat everyone with respect and kindness; not attend with contagious illness that could put others including children at risk; wipe down equipment; report safety issues; wear appropriate clothing/footwear; supervise children's use of toys/equipment.
8. PHOTOGRAPHY & SOCIAL MEDIA
8.1 Our Use
We regularly photograph and video during classes for marketing, social media, website, and promotional materials. By attending, you consent to being photographed/filmed and our use of such content indefinitely. Unless we have your explicit consent, we will not share your child's face on our content.
8.2 Opting Out
Email hello@wisemamas.co.uk at time of joining if you do not consent. We'll make reasonable efforts to exclude you but cannot guarantee you won't appear in group shots. Attending a community space means you may occasionally appear in backgrounds. You do not need to email us to opt out your children. It is our standard to not share children's faces in our promotional content without your explicit consent.
8.3 Your Use
You may take photos or videos of yourself and your children only. No photography/filming of other members or their children without explicit prior consent. No sharing images of others on social media or any platform without explicit permission. Breach may result in immediate termination.
8.4 Tagging
When you tag @wisemamas.fitness on social media, you grant us permission to reshare your content. We appreciate your support.
9. DATA PROTECTION
9.1 What We Collect
Contact details, health information, payment details, attendance records, emergency contacts, photos/videos.
9.2 Legal Basis
Contractual necessity (to provide Services); legitimate interests (safety, operations); consent (marketing, photography); legal obligation (tax, safeguarding).
9.3 Health Data
Collected for your safety. Stored securely, accessed only by instructors who need it. Never shared without consent (except where legally required).
9.4 Storage
Your data is securely stored online in our system. Retained for 5 years after membership ends.
9.5 Your Rights (UK GDPR)
Access, rectification, erasure (subject to legal retention), restrict processing, data portability, object to processing, withdraw consent.
9.6 Marketing
You'll receive essential service emails. Marketing emails only with consent. Unsubscribe anytime via email links or by contacting us.
9.7 Third-Party Sharing
We don't sell data. We share only with: payment processors, booking systems, email platforms, accountants/legal advisors (under confidentiality), authorities where required by law.
10. FACILITY USE
Use equipment as instructed and for intended purpose only. Ask if unsure. Report damaged equipment immediately and don't use it. You're liable for damage from misuse. We're not responsible for loss/theft of personal property. Please secure your valuables. Access during scheduled times only (arrive max 15 mins early).
11. GENERAL TERMS
11.1 Changes
We may update these Terms. Material changes will be notified via email/push notification 30 days before taking effect. Continued attendance to our classes confirms acceptance. If you have questions, contact us at hello@wisemamas.co.uk or cancel per Section 5.3.
11.2 Complaints
Speak to staff or email hello@wisemamas.co.uk. We'll acknowledge within 2 working days and respond within 14 working days.
11.3 Notices
To you: email or in person. To us: hello@wisemamas.co.uk or 12-14 Maunsell Road, St Leonards on Sea, TN38 9NN.
11.4 Governing Law
These Terms are governed by English law. Disputes subject to exclusive jurisdiction of England and Wales courts. We'll attempt amicable resolution first.
11.5 Force Majeure
Not liable for failure to perform due to circumstances beyond reasonable control (natural disasters, pandemics, government restrictions, facility emergencies).
12. ACCEPTANCE
By ticking the box, booking, or attending, you confirm:

✅ I'll exercise within my limits and inform instructors of concerns
